The short version. Swipexy is a tool that helps you delete photos and videos. You decide what gets deleted, and deletion can be permanent, so review carefully. Premium is an auto-renewing subscription billed by Apple that you can cancel any time in your App Store settings. Secret Folder lives only on your device and cannot be recovered by us.
1. Agreement
These Terms of Use ("Terms") are a legal agreement between you and atvrd ("we", "us", "our") for the Swipexy iOS application and this website (together, the "App"). By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The App is distributed through the Apple App Store and is also subject to Apple's Licensed Application End User License Agreement. Where these Terms are less protective of you than Apple's minimum terms, Apple's terms apply.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App, and old enough to enter into a binding contract to purchase a subscription. If you are using the App on behalf of someone else, you confirm you are allowed to accept these Terms for them.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, as permitted by the App Store usage rules. You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer or decompile the App, or attempt to extract its source code, except where the law expressly allows it.
4. Premium subscriptions
Some features (for example deleting the items you reviewed, cleaning up duplicates and Secret Folder) require a Swipexy Premium subscription.
- Plans. Premium is offered as an auto-renewing weekly or monthly subscription. The current price is shown in the App before you buy and may vary by country and currency.
- Free trial. Some plans include a free trial. If you do not cancel at least 24 hours before the trial ends, the subscription starts and your Apple ID is charged. Unused trial time is forfeited when you purchase a subscription.
- Billing and renewal. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same period at the same price unless you turn off auto-renewal at least 24 hours before the end of the current period.
- Cancelling. Manage or cancel in iOS Settings → your name → Subscriptions. Deleting the App does not cancel a subscription. After cancelling you keep Premium until the end of the paid period.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under its policies. Request one at reportaproblem.apple.com. Where the law gives you a right of withdrawal, it is exercised through Apple.
- Price changes. We may change subscription prices. Apple will notify you in advance, and where required ask for your consent, before a new price applies to your renewal.
5. Your content and your responsibility
The App works with photos and videos that are yours and stored on your device. We claim no rights in them and never receive copies of them.
Deleting is your decision. The App only proposes; you confirm. When you confirm, iOS moves items to Recently Deleted for about 30 days and then removes them permanently. Empty that album only when you are sure. Keep backups (for example iCloud Photos) of anything you cannot afford to lose. We are not responsible for media you delete.
Duplicates and suggestions are produced by automated on-device analysis and can be wrong. Two photos flagged as duplicates may differ in ways that matter to you. Look before you swipe.
6. Secret Folder
Secret Folder stores items in the App's private space on your device, protected by a PIN and optionally Face ID or Touch ID. Because of how it is designed:
- If you forget your PIN and cannot use biometrics, there is no reset and we cannot recover the contents.
- Uninstalling the App, erasing the device, or restoring from a backup permanently deletes Secret Folder contents. They are deliberately excluded from iCloud and iTunes backups.
- Secret Folder protects against casual access; it is not a substitute for device encryption, a strong passcode or a proper backup.
7. Acceptable use
You agree not to use the App in a way that breaks the law, infringes anyone's rights, interferes with the App's operation, circumvents purchase or feature checks, or harms other users, Apple or us.
8. Intellectual property
The App, its name, design, animations, code and content are owned by us or our licensors and protected by copyright, trademark and other laws. Apart from the license in section 3, no rights are granted to you. Feedback you send us may be used without obligation to you.
9. Third-party services
The App uses Apple frameworks and Google Firebase as described in the Privacy Policy. Those services are governed by their own terms, and we are not responsible for them.
10. Changes to the App
We may add, change or remove features, and may stop offering the App entirely. If we discontinue a paid subscription, you will not be charged for renewals after that point. We may release updates that are installed automatically according to your device settings.
11. Disclaimer of warranties
The App is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App will be error-free, that duplicate detection will be accurate, or that any deleted item can be recovered.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, photos, videos, profits or goodwill, arising out of or related to the App, even if we were advised of the possibility. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim arose, or 50 USD, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
13. Indemnity
You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising from your breach of these Terms or misuse of the App, to the extent permitted by law.
14. Apple as third-party beneficiary
Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any warranty, product liability, intellectual property or legal compliance claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms. Sections 5, 6, 8 and 11 to 17 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the country in which you reside, without prejudice to any mandatory consumer protection rules that apply to you. Disputes will be resolved in the competent courts of that country. Before starting any formal proceeding, please contact us so we can try to resolve the matter informally.
17. Changes to these Terms
We may revise these Terms from time to time. The effective date at the top will change, and material changes will be shown in the App. Continued use after the changes take effect means you accept the new Terms. The current version is always available at swipexy.atvrd.dev/terms.
